Terms & Conditions
Last updated: 30 October 2026
These terms explain how working with Ocaykar works: how a project is agreed and paid for, what you own at the end, and how either side can end the engagement. They apply to this website and to every project and care plan we provide, together with the Blueprint we agree for your project. If the Blueprint and these terms disagree, the Blueprint wins.
1. Who we are
Ocaykar is the trading name of OCAYKAR (PTY) LTD, a private company registered in South Africa (registration number 2026/540580/07), based in Johannesburg, South Africa. You can reach us at kwantu@ocaykar.com. In these terms, "we", "us" and "Ocaykar" mean OCAYKAR (PTY) LTD, and "you" means the person or business engaging us.
2. Using this website
You may use this website to learn about our services, use the fee calculator and book a Platform Audit. The calculator gives estimates based on public pricing from other platforms, checked on the date shown on the site. It is not financial advice, and your actual costs may differ. Please don't misuse the site, for example by trying to break its security or by submitting false information in our forms.
3. The free Platform Audit
The Platform Audit is a free, no-obligation call. We'll look at your current platform, what it costs you, and what an owned build could cost. Nothing we say on the call is a binding quote. If you can't make a booked call, please reschedule or cancel using the link in your confirmation email.
4. How a project is agreed
Every project starts with a Blueprint: a written plan setting out the features, design direction, migration plan, timeline and a fixed price. The Blueprint becomes binding when you accept it in writing (email is fine) and pay the deposit. Work outside the Blueprint is a change request. We'll quote it in writing before doing it, and it may affect the price and timeline.
5. Prices and payment
- Package prices on this site are starting prices in US dollars, British pounds or euros. Your final price is the one in your Blueprint.
- You pay 50 % of the project price before we start, and the balance before we launch your platform on your domain.
- Invoices are due within 7 days. If a payment is late, we may pause work until it is paid, and the timeline moves by the length of the pause.
- Our prices don't include third-party costs you choose to use, such as payment processing fees (Stripe, PayFast), AI usage (for example OpenAI), domain names or email services. We'll tell you about any of these in your Blueprint.
6. Timelines
Launch timelines on this site and in your Blueprint are good-faith estimates that depend on you sending content, feedback and access on time. We'll agree review dates with you. If feedback or content arrives late, the launch date moves accordingly.
7. What you own
Once you have paid in full, you own the code written specifically for your platform, your design, your content, your data, your domain and your member list. We'll hand over access to the code repository, hosting and database on request.
Some parts of every platform are not ours to give away, and they stay under their own licences: open-source software (such as Next.js and Supabase), third-party services, and any general-purpose tools or code we've built for our own use and reuse across projects. You receive a permanent, royalty-free licence to use those reusable parts as part of your platform.
Unless you tell us otherwise in writing, we may mention that we built your platform and show non-confidential screenshots of it in our portfolio.
8. Your responsibilities
You are responsible for the content you give us and publish on your platform, and for having the right to use it. You're also responsible for your own terms, privacy policy and legal obligations to your members, and for keeping your account logins secure. When we migrate members or data for you, you confirm you're allowed to share that data with us for that purpose.
9. Care plan
The optional care plan covers hosting management, security updates, backups, bug fixes and small updates, as described when you sign up. It is billed monthly in advance and runs until you cancel. You can cancel with 30 days' written notice. Larger changes or new features are quoted separately. Without a care plan, fixes after the 30-day launch warranty below are charged at our standard rate.
10. Launch warranty
For 30 days after launch, we'll fix any bug where the platform doesn't work as described in your Blueprint, at no extra cost. This doesn't cover problems caused by changes made by someone else, or by third-party services changing how they work.
11. Third-party services
Your platform relies on services run by other companies, such as hosting providers, Supabase, payment providers and AI providers. We choose reliable providers, but we aren't responsible for their outages, price changes or decisions. Your use of them is also subject to their own terms.
12. Ending a project
- Either side may end a project by written notice if the other seriously breaches these terms and doesn't fix the breach within 14 days of being asked.
- You may end a project at any time by written notice. You pay for work done up to that date, and the deposit is not refundable once work has started.
- When a project ends, we'll hand over the work you've paid for.
13. Liability
We build carefully, but no software is perfect. To the extent the law allows, our total liability to you for any project is limited to the amount you've paid us for that project, and we aren't liable for indirect losses such as lost profits or lost revenue. Nothing in these terms limits any rights you have under the Consumer Protection Act or any other law that can't be excluded.
14. Confidentiality
We keep your business information, member data and login details confidential, and use them only to deliver our services. This doesn't apply to information that is already public.
15. Changes to these terms
We may update these terms from time to time. The version on this page applies to new projects from the date shown at the top. Projects already under way stay on the terms in place when you accepted your Blueprint.
16. Law and disputes
These terms are governed by the laws of the Republic of South Africa. If a dispute arises, we'll first try to settle it by talking. If that doesn't work within 30 days, either side may take it to the courts of South Africa.
